Unless otherwise stated, these Terms and Conditions are governed by Czech law, specifically Act No. 89/2012 Coll., the Civil Code.
Definitions
- “Us” or “Prague Journeys” refers to the provider of guided walking tours as described herein.
- “Guide” means the person authorized by the Company to lead and conduct the Tour.
- “Tour” refers to any guided walking tour or related service organized and provided by Prague Journeys.
- “Client” means the individual or entity who books and/or participates in a tour provided by Prague Journeys.
- “Participant” refers to any person taking part in the Tour, including the Client and any additional persons included in the booking.
- “Terms and Conditions” means this agreement, including all rules, policies, and provisions governing the relationship between the Company and the Client.
- “Force Majeure” refers to events or circumstances beyond the reasonable control of either party, including but not limited to natural disasters, war, pandemics, government restrictions, temporary restrictions based on local conditions, or other emergencies.
1. Service Description and Scope
- Our walking tours are guided experiences conducted on foot at pre-arranged locations, dates, and times.
- The service includes guiding, commentary and route planning.
- The service does not include refreshments, meals, entrance fees to attractions or sightseeings or transportation unless explicitly stated.
- Additional costs may apply for optional services such as transfers or extended tour duration, as well as for needing to handle unexpected situations caused by force majeure.
2. Booking and Payment
- A non-refundable deposit of 50 % is due to pay at the time of booking. The deposit secures the time slot of your booking and covers administrative costs and fees.
- The remaining balance is due to be paid during the tour unless otherwise agreed.
- Payment can be made by accepted payment methods (wire transfer, online payment provider). Payments on site can be made also in cash (EUR or CZK using actual exchange conversion rate).
- All prices are quoted in EUR and include applicable taxes and payment fees.
3. Cancellations, Changes, and Refunds
- The deposit is non-refundable.
- Cancellations or changes resulting from force majeure or unforeseen circumstances do not alter the non-refundable nature of the deposit.
- Cancellations by the Client if the full tour price is paid prior to the day of the tour:
- For the sake of this section, the day of the tour is the day 0.
- More than 7 days (i.e. the 8th day and earlier) before the tour: Full refund minus deposit.
- There are no refunds if the cancellation takes place on the 7th day or less before the tour.
- Cancellation due to client no-shows:
- Failure to arrive at the agreed meeting point within the period of 30 minutes after the scheduled start time will be treated as a no-show and is non-refundable.
- Changes by the client:
- Requests to change the date, time, or details of your booking must be made in writing and are subject to availability and may involve administrative fees.
- Cancellations by Prague Journeys:
- We reserve the right to cancel or reschedule tours due to force majeure, unsafe conditions, or insufficient bookings. In such cases, you will be offered a rescheduled date or a full refund.
- The agreed itinerary is subject to change in the event of force majeure or unforeseen circumstances. This may include, but is not limited to, unexpected closures of sites, changes in opening hours or availability, or access restrictions imposed by authorities. In such cases, the itinerary will be adjusted as necessary and every effort will be made to remain as close to the original plan as possible.
4. Tour Course
- The tour is scheduled to commence at the agreed start time on the agreed meeting point. In the event of a late arrival by the Client, any waiting time will be considered part of the total tour duration. The tour will conclude at the originally scheduled end time, and no extension will be provided for late arrivals.
- The change of the meeting point by the Client less than 2 hours prior to the tour may incur delays to the tour start time. This delay will be considered part of the total tour duration and will not affect the tour conclusion time.
- For tours exceeding three hours in duration, we reserve the right to include a break of 20 to 30 minutes. During this break, your guide will remain available to answer questions and provide assistance, such as helping with refreshments or other needs.
5. Liability and Risk
- Participation in walking tours involves inherent risks, including but not limited to slips, falls, weather conditions, and interactions with traffic or risks involving passing through touristically exposed and crowded areas.
- By booking, you acknowledge and accept these risks.
- We are not liable for any personal injury, loss, theft or damage to property except where caused by our proven negligence.
- We recommend all participants have appropriate travel and health insurance.
6. Participant Responsibilities
- Participants must ensure they are physically able to undertake the tour and should inform us of any relevant medical conditions or mobility issues at the time of booking.
- Children under 15 years of age must be accompanied by an adult.
- Participants must follow the guide’s instructions and behave respectfully towards the guide, other tour participants, landmarks and monuments and the other public, according to a basic code of conduct.
- We reserve the right to exclude from the tour any participant who poses a risk or disrupts the tour. Such participants are not eligible for any kind of refund.
- Participants are required to comply with all rules and regulations of any monuments, museums, cultural, or sacred sites included in the tour. If a participant is excluded, removed, or banned from any such site, no compensation or refund will be provided. It is the participant’s responsibility to dress and conduct themselves appropriately in accordance with the requirements of each site.
7. Weather, Environmental and Cultural Conditions
- Tours operate regardless of the weather condition. However, we reserve rights to modify (change the route, time schedule etc.), to shorten, or to cancel a tour if conditions are unsafe.
- Participants are responsible for dressing appropriately for the weather and terrain.
- Underestimation of the weather conditions from the participant site is not a valid reason for cancellation or shortening of the tour.
8. Group Size and Composition
- All tours are private, unless stated or agreed otherwise.
- The number of participants must be known and determined at the time of booking of the tour to provide the exact pricing and estimation of additional expenses.
- If agreed beforehand, at the time of booking, it is possible to make the group size variable. This may involve changes to the calculation of the final price of the tour.
9. Intellectual Property and Privacy
- All tour content, commentary, and materials are our intellectual property and may not be recorded, reproduced, or distributed without permission.
- We may take photographs during tours for promotional purposes. Please inform us in advance if you do not wish to be photographed.
- Personal information provided during booking will be handled in accordance with our Privacy Policy/statement.
10. Dispute Resolution and Governing Law
- Any disputes arising from these terms or your participation in our tours will be governed by the laws of jurisdiction of the Czech Republic.
- We encourage clients to contact us promptly with any concerns or complaints so we can resolve issues amicably.
11. Amendments
We reserve the right to update these Terms and Conditions at any time. The version in effect at the time of your booking will apply to your tour.
12. Emergency Procedures
- In case of emergency during the tour, please follow your guide’s instructions and contact local emergency services if necessary.
